1. Acceptance of Terms

Welcome to Collide. By accessing or using our website, applications, or services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Services.

2. Description of Services

Collide is a platform that allows brands to discover and connect with creators; creators to showcase profiles, analytics, and audience insights; and both parties to explore potential sponsorships, endorsements, and collaborations. You can create an account with an email address and password, or by connecting an Instagram or TikTok account. Connecting a social account is optional and is used to import public profile information and analytics.

3. Eligibility

You must be at least 13 years old to use Collide. If you use Collide on behalf of a brand or company, you represent that you have authority to bind that entity to these Terms.

4. Account Registration and Connected Accounts

To access certain features, you may connect your Instagram (Meta) or TikTok account. By doing so, you authorize Collide to access permitted profile information and analytics in accordance with these Terms, our Privacy Policy, Meta’s Platform Terms and Policies, and TikTok’s Developer Terms of Service. You may disconnect a connected account at any time from your profile settings. You are responsible for maintaining accurate account information and for keeping your password secure.

5. User Responsibilities

You agree not to misrepresent your identity, brand, or analytics; use Collide for fraudulent, deceptive, or unlawful purposes; scrape or misuse data from other users; or attempt unauthorized access to the platform. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Creator and Brand Interactions

Collide does not guarantee sponsorships, endorsements, or payments; is not a party to agreements between brands and creators; and does not manage or enforce collaborations unless explicitly stated. All negotiations and agreements occur directly between users. Where Collide facilitates a payment between users through a third-party payment processor, any applicable platform fees are disclosed at the time of the transaction.

7. Content and Data

You retain ownership of your content. By using Collide, you grant us a limited, non-exclusive license to display and process content and analytics solely to operate and improve the Services.

8. Analytics and Insights

Collide may display Instagram and TikTok analytics and performance insights based on your authorization. Analytics are provided “as is” and may not be complete or error-free.

9. Data Deletion

You may request deletion of your personal data at any time by disconnecting a connected Instagram or TikTok account, by emailing collidedevs@collide-app.com, or through the automated request endpoint at https://collide-app.com/api/data-deletion. Upon request, Collide will delete stored personal data associated with your account within a reasonable timeframe, unless retention is required by law or for legitimate business purposes. 10. Termination

You may stop using Collide at any time. We may suspend or terminate access if you violate these Terms or if required by law or platform partners. Upon termination, your account data may be deleted in accordance with our data retention and deletion practices.

11. Disclaimers

The Services are provided “as is” and “as available.” We make no warranties regarding availability, accuracy of analytics, or outcomes of collaborations.

12. Limitation of Liability

To the fullest extent permitted by law, Collide is not liable for indirect, incidental, or consequential damages, including lost profits or disputes between users.

13. Indemnification

You agree to indemnify and hold harmless Collide and its operators from claims arising from your use of the Services or violation of these Terms.

14. Changes to the Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date.

15. Governing Law

These Terms are governed by the laws of the applicable jurisdiction in which Collide operates, without regard to conflict of law principles.
